On 24 Aug 1761 in Augusta County, Virginia, regarding the case of John Mills & executors of Erwin Patterson deceased plaintiffs against Mathew Emacks defendant, "the defendant by his attorney says that he did not assume in manner and form as the plt. agst. him complains and of this he puts himself upon the Country and time is given the plaintiff until the next court to consider the plea."
On the same day and place, regarding the case of John Mills, Thomas Rogers and James Patterson executors of Erwin Patterson deceased plaintiffs against James Neilly defendant, the case was continued at the defendants motion and cost.
On the same day and place, regarding the case of John Mills, Thomas Rogers and James Patterson executors of Erwin Patterson deceased plaintiffs against George Robinson defendant, "the defendant being sumoned and not appearing the plaintifs by their attorney produced his note of hand for 3 pounds 12 shillings and 2 pence judgement is therefore granted the plaintif against the said defendant for the same together with cost and the defendant in mercy."

On 20 Nov 1761 in Augusta County, Virginia, regarding the case of John Mills & executors of Erwin Patterson deceased plaintiffs against Mathew Emacks defendant, "the defendant having put in his please and the plaintif joining in the issue the tryal thereof is refered to the next court."
On the same day and place, regarding the case of John Mills, Thomas Rogers and James Patterson executors of Erwin Patterson deceased plaintiffs against George Robinson defendant, "this day came the plaintifs by their attorney and the deft. being again called and not appearing the conditional judgment against him and William Graham his security is confirmed for 8 pounds 10 shillings due by promisary note which they are ordered to pay unto the plaintifs together with costs and the deft. in mercy."

On 24 May 1765 in Augusta County, Virginia, the court decided on the chancery case of John Neelley Plaintiff against John Mills, James Rodgers and James Patterson executors of Erwin Patterson deceased Defendants.
"This cause was this day heard on the bill and answer of the defendant John Mills on consideration of which it is ordered and decreed that the injunction obtained by the plaintiff to set aside a judgement obtained by the testator Erwin Patterson in his lifetime against him be desolved and that the plaintiff pay unto the defendants their costs by them about their defence in this behalf expended defts cost tobacco 30/"
NOTE: This was about one year before James Rodgers was married to Margaret.

On 29 Aug 1767 in Augusta County, Virginia, Thomas Rogers had 225 acres of land surveyed. The land was described as being in Augusta County "on Looney's Creek a branch of James River; beginning at two black oak saplings on the South side of the branch by the foot of a ridge near James Moris land N 20 W 38 poles crossing the branch to a white oak & walnut saplings, S 75 W 90 poles to a hickory & black oak saplings on a hill, S 30 W 50 poles to a Spanish oak corner to the land of Wm. McClellon's and with this line S 30 E80 poles to a white oak , S 7 W 40 to a white oak, SW 48 poles to a black & one white oak saplings, N 60 W 48 poles to three black oak saplings in a hollow, thence S 30 W 80 poles to a hickory, S 100 poles to 3 white oak saplings, N 80 E 40 poles to a black oak, N 10 E 34 pole sto a black oak N E 78 poles to a white oak, S 70 E 60 poles to a white oak by a branch, N 36 E 84 poles crossng the branch, thence N 170 poles to the beginning."
NOTE: This tract of land was later located within Botetourt County, which was created from a portion of Augusta County in 1770.

On 21 Mar 1768 in Augusta County, Virginia, regarding the case of Robert Looney plaintiff against John Mills, James Patterson and Thomas Rodgers executors of Erwin Patterson deceased defendants, "the defendant having put in his plea and the plaintif joining in the issue the ___ thereof is ref__ to the next court."
On the same day and place, regarding the case of John Buchanan, William Thompson, Silas Hart and William Preston executors of James Patton Gent. deceased plaintiffs against William Graham and John Mills his security, and Thomas Rodgers, John Mills and James Patterson executors of Erwin Patterson deceased defendants, "this day came the plaintiffs by their attorney and the defendants William Graham and john Mills being arrested and being called and not appeared on the motion of the plaintiffs. It is ordered that judgement be entered for them against the defendant William Graham and David Robinson his security and against the defendant John Mills and against the said John Mills as executor of the said Erwin Patterson deceased for the debt in the declaration mentioned and costs unless the said defendants Thomas Rodgers and James Patterson not being arrested on the motion of the plaintiff an alias capias is awarded him against the said defendants returnable here the next court."

On 20 Mar 1770 in Augusta County, Virginia, Joseph & wife Elizabeth Poindexter sold 143 acres of land to Thomas Rodgers for 50 pounds current Virginia money. The land was described as "beginning at a walnut sycamore and gum on the North side of Shanandoa River on John Patricks lines and with the same South 78 W 67 poles to a white oak corner to Poindexters land, and with his line N 20 W 244 poles to some marked grubs, and thence S 65 E 158 poles with Thomas Turks line to the said river, and thence up the river 160 poles to the beginning." The witnesses to the deed were John Rodgers, James Kennerly Junr. and Saml. Woods. Joseph & wife Elizabeth Poindexter swore oath and proved the deed in court on the same day.

On 20-21 Aug 1770 in Augusta County, Virginia, John Lewis of Albemarle County lease & released 164 acres of land to William Glaves for 40 pounds current Virginia money. The witnesses were Thomas Rogers, James Kennerly Jnr. and Thomas Turk.

NOTE: He was listed nearby Wm. McNeelly, David McNeelly (and son Geo.), Thos. Kennerly (and negro Dina), Isaac White (sons Isaac, David & James; negro Pharah), Thomas Turk, James Kennerly Junr (and negro Till), and many others.
Thos. Rodgers appears listed immediately below a Seth Rogers (with servant Thos. Uppen[sp?]). A Robert Rodgers (with servant Lewis Williams) appears six lines below, in the next column.

On 20 May 1771 in Augusta County, Virginia, Thomas & wife Betty Rodgers sold 143 acres to James Kennerly for 100 pounds. This was the same tract of land purchased from Joseph & wife Elizabeth Poindexter on 20 Mar 1770.
On 10 Aug 1775 in Augusta County, Virginia, Isaac White wrote his last will and testament. Within it he bequeathed to his two married daughters Elizabeth Rodgers and Sarah Rodgers.
NOTE: Records for Thomas Rodgers show his wife's name as "Betty." The 1771 list of tithables does show Thomas Rodgers in the same vicinity as Isaac White. This likely reflects that "Betty" was Elizabeth White.
