The Custaloe-Custillo Enslaved & Free People of Colour
There were handfuls of families surnamed Custaloe, Custalow, Custilo, Custillo, etc. appearing in early Virginia records, who were listed as "free people of colour." This is my attempt to piece these many families together and determine whether they're related to one another, related to the Mattaponi Custalow family and potentially related to our Costilow family.
The vast majority, if not all of them, were born or residing in Richmond, Virginia at some point in time. While Richmond had one of the largest and most prosperous communities of free Black people in the South, it was also the domestic slave-trading capital of the United States. Several of these families left Virginia for greater opportunities, as well as to secure their freedom, in Massachusetts, Ohio, Pennsylvania and also Canada.
These family groups are organized chronologically, by locality, under the eldest member of their documented family. We cannot assume all of these individuals are immediately related, or related at all, without further proof.
The spelling variations for their surname found throughout my research include

On 13 Dec 1783 in Culpeper County, Virginia, John Revely of Buckingham County sold a "negro fellow named Castilio" to his daughter Mary Revely for 5 shillings. The witnesses to the deed were Adam Newall and William Beazley. The deed was proven in court on 17 May 1784 by Adam Newall and William Beazly.

The 1790 tax list for Surry County, Virginia shows Castillo (no surname) being taxed on 1 negro over 16 years and 1 horse.

On 1 Jan 1793 in Surry County, Virginia, Mary "Polly" Revely wrote her last will and testament; she bequeathed the following:
"I give my negro man by the name of Castilio after his serving Thomas Bland this year whom he now lives with his freedom forever."
"I desire my father John Revely may have the money due on Thomas Blands bond for hire of Castilio for the year 1792, and also the hire for the same negro in 1793 with what money I have by me amounting to 15 pounds 16 shillings (after my just debts are paid) and the balance that may be due to me from the estate of Col. John H. Cocke on a settlement the whole of the moneys I wish to be put in the hands of Mr. Croughton Merchant in Fredericksburg for my fathers use."
"It is my desire that $6 may be divided amongst the servants where I now live."
The witnesses to the will were Richard Cocke Jr. and Ann H. Cocke. Richard Cocke proved the will in court on 25 Feb 1793.

An 1813 from Hanover County, Virginia for "free negroes & mulattoes above the age of 16 years" shows what might be Jemima Custillo. She was listed as "Jamima with Mary Pope" and taxed on 1 poll. Mary Pope herself was taxed on 5 negroes over the age of 16 and 2 horses.

On 18 Jun 1852 in Richmond, Virginia, Jemima Custillo, a free woman of colour, surrendered her register to be destroyed and the court was directed to register her anew in the office.

Jemima Custillo registered as a free person of colour with Henrico County, Virginia on 9 Nov 1852. She was 77 years old and stated she was born in Hanover County. She was physically described as having a yellow complexion, cited as asian, 5'3" with no marks or scars. She also registered her child, Peggy Carter, who was 52 years old, 4'11" and had a faint scar on her left wrist from a scald. They were both born free.

The 1805 property tax list for the Upper District of Henrico County, Virginia, lists Reuben Custaloe a "F[ree] N[egro]."

An 1808 list of free people of color for Cumberland County, Virginia, lists Reuben Castillo. He is described as being 32 years old, about 5'8", of a light black color and born free in Hanover County.
On 28 Dec 1808 in Hanover County, Virginia, Reuben Custillo registered as a free born man. He was described as being "about thirty two years old, about five feet eight inches high, light black colour, a scar over his right eye brow & a mould upon his right cheek."

On 14 Mar 1798 in Richmond, Virginia, the court oversaw a case between James Custeloe against Richard Crouch, regarding a "force and injury." Richard Crouch plead not guilty and and the court ordered the writ of inquiry award against the defendant to be set aside. A jury swore oath and said the defendant was guilty and awarded the plaintiff 40 shillings, besides court costs.

On 12 May 1802 in Richmond, Virginia, the court recorded the "by consent of William Marshall Gent. the attorney prosecuting for the Commonwealth in this Court, it is ordered that these presentments be respectively dismissed."

James Custaloe was involved in several court suits that was ultimately from violent behavior, trespassing, etc. However, in 1803 in Richmond, Virginia, an investigation was begun into the death of James Custaloe's child; he himself was accused of murdering his own child.
The 1803 personal property tax for the Lower District of Henrico County, Virginia shows James Custalow, a free mulatto.

On 11 Mar 1803 in Richmond, Virginia, the court oversaw a case of "trespass assault and battery" between James Custaloe plaintiff against Leighton Wood defendant. The court also oversaw the case of Leighton Wood plaintiff against James Custaloe defendant. "By consent of the parties these suits are dismissed, the same having been agreed." Â The court further "ordered that James Custaloe pay unto Willow Rowlett the sum of $1.50 for his attending this court three days as a witness for him in his suit."

On 11 Mar 1803 in Richmond, Virginia, the court "ordered that James Custaloe pay unto Willow Rowlett the sum of $1.50 for his attending this court three days as a witness for him in his suit."

On 5 Nov 1803 in Richmond, Virginia, the newspaper The Virginia Gazette, published an article mentioning James Custello:
"TO BE SOLD
On the Fifteenth day of November next, will be Sold to the highest bidder, a FRAME HOUSE, lately occupied by Messrs. Nagly & Cox, as a Slaughter-house at Rockets:-Also, a Frame house, lately occupied by James Custello. Both the above houses are built upon ground-rent, and will be sold for cash.

On 17 May 1804 in Richmond, Virginia, the court oversaw a case between Francis Nicholas Guto & his wife Susanna plaintiffs against James Custaloe defendant, in regards to trespass, assault and battery. The suit was dismissed by the plaintiff's order.

On 11 Sep 1804 in Richmond, Virginia, the court ordered "the attachment of Michael Bowzer against James Custaloe is dismissed for want of prosecution." The court further ordered "the attachment of John Lester against James Custaloe is dismissed for want of prosecution."

On 11 Mar 1805 in Richmond, Virginia, the court brought prisoner James Custaloe, accused of murder, to appear for testimony before sundry witnesses; they found him guilty of the offence. The court ordered a trial be held in Richmond and James Custaloe was remanded to jail. The court further ordered David Lambert, John Adams and Constantin Johnson to appear in court as witnesses, under penalty of 100 pounds each. The court also ordered Samuel McCraw, Peyton Randolph, Andrew Stevenson and James Whitelaw to bring Betsy a negro girl (property of Harwood Bullington) to appear before the court and testify, under penalty of 100 pounds.

On 12 Dec 1805 in Richmond, Virginia, James Custilo recorded a debt owed from the estate of Mary Brown, for funeral expenses amounting to $37.25. He may have been the individual who dug and prepared Mary Brown's grave.

On 10 Nov 1807 in Richmond, Virginia, the court allowed a bill of misdemeaner against James Custaloe. Two days later, on 12 Nov 1807, the sergeant of Richmond led James Custaloe in custody to stand indicted for misdemeanor; no evidence was adduced against him and it was ordered he be discharged.

On 13 Nov 1809 in Richmond, Virginia, James Custaloe was accused of selling "spiritous liquors without a license" by William Dyer. James Custaloe was summoned by the court and William Dyer "appeared in discharge of his recognizances entered into before the Master of Police, on the 17th day of last month, to answer the complaint of James Custaloe for a breach of the peace."

On 30 May 1816 in Henrico County, Virginia, John Lester sold 7,980 sq ft of land to Elizabeth Custeloe and her daughter Susan Custeloe for $1, "but the more especially for the benevolence and esteem which the said John Lester bears towards the said Elizabeth Custaloe wife of James Custaloe and their daughter Susan Custaloe." The tract of land was described as being in Henrico County on the County Road leading from the city of Richmond towards that of Williamsburg. It began at the intersection of the line of the ground sold by John Lester and wife on the said Road, thence on the same North three degrees East 71 feet on the said Road, thence 85 degrees West 119 feet to a stone, thence South 5 degrees East 70 feet to that of Benjamin Philips estate, thence on that line North 85 degrees East 119 feet to the beginning. The deed was proven in court by John Lester on the same day. Less than a month later, James Custiloe, wife Elizabeth and daughter Susan sold the same 7,980 sq ft tract of land to Peter Ralston for $375.
On 29 Oct 1816, an article appeared in the Lancaster Intelligencer, published out of Lancaster, Pennsylvania mentioning the murder of James Custaloe:
"Richmond, Oct. 29.
We understand that a white man has been committed to the jail of this city, on a charge of murder! The transaction took place on Thursday night last,- The deceased was a man of colour, a very honest and industrious man; with a very respectable and thriving family;- he had just procured an oyster cart, to supply our market with oysters, and was engaged in his fair and profitable vocation when he was cut off from life. On that evening, he was driving his cart along the street of our city; when he was hailed by a white man of the name of Vial- he subsequently declared he did not hear the hail- but Vial, who supposed he did, flew in a rage, rushed upon him, dragged him from his cart, threw him upon the ground, stamped him, and beat his head with a weight which he unluckily happened to have in his hand. A gentleman, who was present, attempted to interfere at the risk of some danger to himself- But perhaps the death blow had been already dealt. The poor creature remounted his cart and succeeded in reaching his home- During the night, his wife was aroused by his groans, & before she could get a light, he had breathed his last- supposed to have been suffocated with blood. Vial is now in jail- Far be it from us to prejudice the public mind, to interfere with the venerable administration of justice, or to represent an unhappy man now in the custody of the law- But it is impossible to breathe the name of poor Custeloe, the sufferer, without the deepest commiseration."
On 31 Oct 1816 in Richmond, Virginia, a court was called for the examination of Seymour Vial, charged with "having feloniously killed and murdered James Custaloe a man of colour." The sergeant led the prisoner to the bar and the court, after hearing and reviewing evidence and arguments from attorneys from both parties, found Seymour Vial guilty of the offence. The court ordered that Vial undergo a trial before the next Supreme Court for Henrico County. The prisoner, Seymour Vial, was remanded back to jail.
-A man named Charles Palmer, a witness for the Commonwealth, swore oath and said "that on Thursday evening, the 24th instant between 7 & 8 o'clock, he heard a noise in the street, went out and saw the prisoner beating the deceased Custaloe with his fist, Custaloe standing bleeding without resistance. Witness asked the prisoner to desist, saying that if Custaloe had behaved amiss, the laws would punish him. The prisoner replied damn the laws, the witness & Custaloe, declaring that he would beat him himself and would serve the witness in the same way if he interfered. The prisoner assigned no reason for beating Custaloe. The witness saw Custaloe dead the ensuing morning. The lower part of both jaws appeared much bruised and swollen."
-A man named Meredith Alvis, a witness for the Commonwealth, swore oath and said "that he saw the prisoner have Custaloe by the collar, his mouth and face being bloody."
-A man named John Wright, a witness for the Commonwealth, swore oath and said "that he saw the prisoner strike Custaloe two or three times with his right hand holding him with the left, the last blow being near the left temple, at which Custaloe fell against the cart, and the prisoner then kicked him in the side."

The court minutes, recorded on 24 Jun 1831 in Richmond, Virginia, state that David Sullavan acknowledged a bill of sale to Elizabeth Custalo. The property consisted of nothing but chattel, indicating David and Susan likely moved away.

Obetz, states The Second Baptist church (a colored congregation) was "set off from the First church in 1836, but was not organized until 1839. The original members of this church were Ezekiel Fields, Letha Fields, Miles Fields, Patsy Booker, George and Mary Butcher, Pleasant and Catherine Litchfield, William Gardner, Sarah Woodson, Priscilla Flood, Phoebe Randall, Shubal Fields, David and Susan Sullivant and Susan Watson."

On 6 Sep 1837 in Richmond, Virginia, Kesiah Stewart, a free woman of colour of Frankfort, Kentucky sold a tract of land to John Tinsley, a free man of colour late of Richmind, Virginia and presently of Cincinnati, Ohio. The tract of land was sold for $2 and was described as "fronting eighty one feet eight inches on 11th Street in Richmond and running back that width one hundred and thirty feet, being the southern half of lot number three hundred eight two (382)." On 27 Feb 1841 in Norfolk County Virginia, William Custaloe a free negro man was sued by Charles H. Shield for a "breach of good behavior." William Custaloe was required to provide a bond of $100, with William Garnett as his security, to ensure his good behavior for the term of 12 months. The court further ordered that he "keep the peace and be of good behavior to roads [and] all the citizens." Shortly before this, the family had moved to Cincinnati, Ohio.
